Senate Floor Amendment 1 to SB 635 (Senator Feigenholtz, D-Chicago) creates the Faith-Based Housing and Mixed-Use By-Right Act, which would require local governments to allow multifamily and mixed-use developments as by-right uses on faith-based property. The amendment prohibits local governments from requiring discretionary approvals for qualifying developments and limits local authority to applying generally applicable, objective health and safety standards. The proposal also limits home rule authority.
