Senate Amendment 1
Senate Amendment 1 to SB 636 outlines a process by which Illinois county boards shall appoint a representative to serve on their local Veterans Assistance Commission (VAC). The appointee must be a veteran and would serve a four-year term. The county board vote to appoint a qualified individual must be unanimous.
County Board Appointee Voting Authority
The county-appointed representative would have general voting rights but could not vote on issues involving potential conflicts of interest, such as a closed session meeting of the Commission to discuss litigation against the county. Other potential conflicts of interest that would restrict the appointee's voting authority would be determined by a majority vote of the Commission.
Appointee Prohibited from Holding Other VAC Office
The appointee is restricted from holding any office within the Commission.
Powers of Commission and Superintendent
The amendment clarifies that nothing in the proposed statutory change shall be interpreted to abrogate or diminish any of the powers or authority of the Commission or the VAC superintendent.
The county board is required to invite the VAC superintendent to present official updates to the board, rather than relying on the county appointee for reports.
Remedy for Failure to Submit Audit Report
The amendment also provides that if the VAC does not submit its audit report to the county board, the board leader may request enforcement assistance from the Illinois Attorney General’s Office.
